Layla: "As-salaamu alaikum!

"Taking into account that abortion in islam is not just a sin, but also equal to murder I am interested on the view of shariah law on pregnancies, which were a consequence of incest or rape. What about on the fact that giving birth can be critical for the mother...How to decide? Baby or the mother?

Thank you for your answer!"

Abortion and islam

We alejkumu selam!

Islam forbids all kind of abortion after the 40th day of pregnancy! In Muslim it is stated from Ibn Mes'ud: "I have heard The Messenger of God s.a.w.s. said: 'When drops of seeds (wich impregnated the egg) pass by 42 nights, Allah s.w.t. sends one of His angels, who give form, make the hearing, eyesight, skin and bones. Then he asks: 'O My Lord! Would it be a male or a female?' And God decides...'"

In the other note it is revealed about 40 nights. The hadiths insinuate into that abortion is forbidden after the 40th or the 42nd night, bacause organs start to form.

God speaks about killing (childern):

"When the female (infant), buried alive, is questioned -For what crime she was killed" (81:8-9) (The Arabs used to bury alive their female childern)

"...and do not kill the soul which Allah has forbidden except for the requirements of justice..." (6:151)

"Lost are those who slay their children, from folly, without knowledge, and forbid food which Allah hath provided for them, inventing (lies) against Allah. They have indeed gone astray and heeded no guidance." (6:140)

"...if any one slew a person - unless it be for murder or for spreading mischief in the land - it would be as if he slew the whole people: and if any one saved a life, it would be as if he saved the life of the whole people." (5:32)

"Kill not your children for fear of want: We shall provide sustenance for them as well as for you. Verily the killing of them is a great sin." (17:31)

As regards to the part: "What about on the fact that giving birth can be critical for the mother...How to decide? Baby or the mother?"

The thing is very simple. If there is a possibility that the child will threaten the health of the mother, then the abortion it is allowed. For such a thing it is required a precise analysis of doctors.

If the complications arrive in the birth, then the mother has the priority.

Allah and His Messenger Muhammed s.a.w.s. know best!

We hope, we did a good job.
